FIR and the Current Criminal Procedure Law

The earlier procedure for registration and supply of FIRs was principally governed by Section 154 of the Code of Criminal Procedure, 1973 (CrPC).

With effect from 1 July 2024, the CrPC has been replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).

Under Section 173 BNSS, information relating to a cognizable offence may be given to the officer in charge of a police station, including through electronic communication in accordance with the statutory requirements. This provision reflects the present legal framework governing information relating to cognizable offences.

Important for older FIR guides Older online guides may still refer only to Section 154 CrPC. Since 1 July 2024, current references should also take account of Section 173 BNSS.

FIR Copy and Investigation Status Are Different

FIR The First Information Report records information relating to the commission of a cognizable offence and sets the criminal investigation in motion.
Investigation Status This concerns later police investigation, including collection of evidence, examination of witnesses, arrest where applicable, filing of a police report or charge-sheet and other investigation-related action.

Viewing an FIR online therefore does not necessarily mean that the complete investigation record or current case status will appear on the same page.

The BNSS also contains provisions concerning investigation and communication of investigation progress to the informant or victim in specified circumstances.
