Legal position and privacy considerations

Whether verification is compulsory in a particular situation may depend on a specific statute, licence condition, regulatory requirement, employment sector, government direction, contractual requirement or valid local order. Employers should therefore check the rules that apply to their particular business or establishment.

India's principal criminal-law codes changed on 1 July 2024, when the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita, 2023 and Bharatiya Sakshya Adhiniyam, 2023 came into force. These criminal-law reforms should not, by themselves, be presented as a general employee-verification mandate.

Employee-verification applications involve personal information. Collect and submit only information legitimately required for the verification process, protect employee documents from unauthorised access, and use the information for the stated purpose.
