Gujarat FIR Copy Online: Important Legal Update
The criminal procedure relating to registration and supply of FIRs is now governed by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which replaced the Code of Criminal Procedure, 1973 for matters covered by the new law.
Section 173 of BNSS, 2023
Section 173 BNSS deals with information relating to cognizable
offences. Information may be given orally or by electronic
communication, subject to the statutory requirements. Section 173(2)
provides that a copy of the information as recorded must be given
forthwith and free of cost to the informant or victim.
Thus, the right to obtain the recorded FIR/information should not be confused with the availability of a particular FIR for public online search. The Gujarat Police online portal is an additional digital facility; the statutory provisions continue to apply even when an FIR is not available through an online search.
Section 230 of BNSS, 2023
Section 230 BNSS provides for supply of the police report and other
documents to the accused and, where applicable, the victim
represented by an advocate. It specifically includes a copy of the
FIR recorded under Section 173. The provision requires the
Magistrate to furnish the specified documents without delay and, in
the prescribed circumstances, within fourteen days of production or
appearance of the accused.
Electronic supply of documents is also recognised under Section 230 where the statutory conditions apply.
If the FIR is not available online
An FIR may not appear in the online search for several reasons, including:
- The FIR has not yet been uploaded or made available on the public portal.
- An incorrect district or police station has been selected.
- The FIR number or date has been entered incorrectly.
- The FIR is outside the searchable period or database.
- Access to the particular FIR or portions of its contents is restricted.
- The Gujarat Police portal has changed its service structure or is temporarily unavailable.
In such a situation, verify the details with the concerned police
station or use the official Gujarat Police contact/service
facilities.
FIR copy and online FIR search are different
An important distinction should be kept in mind:
Online FIR Search:
This refers to searching the FIR database through the Gujarat Police
online facility.
Copy of FIR:
This refers to obtaining the FIR/document itself. Section 173(2)
BNSS specifically provides for a free copy to the informant or
victim of the information as recorded.
Therefore, failure to find an FIR through the public online search does not necessarily mean that no FIR has been registered.
Gujarat Police Online Services
Gujarat has implemented the eGujCop system for digitisation and integration of police-related functions. Government documentation states that the citizen portal includes services such as FIR copy, online crime reporting, missing/stolen property reporting, police verification and other police-related services.
The Gujarat Informatics Limited description of the Home Department portal also identifies online citizen services including FIR-status tracking and police-related applications.
Frequently Asked Questions
Can I get a Gujarat Police FIR copy online?
Yes. Gujarat Police has provided online citizen services for
obtaining FIR copies and FIR details. Availability of a particular
FIR depends on the current online database and applicable access
restrictions.
What is required to search for an FIR?
Generally, details such as the district, police station, FIR number
and FIR date can be useful. Additional information such as the
accused or complainant name may also be available as search
criteria.
Can I download and print the FIR?
Where the current Gujarat Police portal provides the download/print
facility for the particular FIR, you can download or print the
displayed FIR.
What if I cannot find my FIR online?
Check the FIR number, police station, district and date again. If
the record is still unavailable, contact the concerned Gujarat
Police station or use the official Gujarat Police website for
further assistance.
Does BNSS change the law relating to FIRs?
Yes. The Bharatiya Nagarik Suraksha Sanhita, 2023 now contains the
relevant criminal-procedure provisions. Section 173 deals with
information in cognizable cases and Section 230 deals, among other
things, with supply of the FIR and other documents in proceedings
instituted on a police report.
Note: Online police portals are periodically redesigned or their service URLs changed. If an old direct FIR link does not open, use the current official Gujarat Police/Home Department website and navigate to the citizen FIR service. This page is intended for general information and guidance; users should verify the current procedure directly from Gujarat Police before relying on it.
