Current Law Governing Death Registration
Section 12 now provides for a certificate of registration to be given free of charge, electronically or otherwise, after registration is completed and not later than seven days, in the prescribed form and manner.
Section 13 governs delayed registration. Following the 2023 amendment, a registration delayed beyond thirty days but within one year requires the written permission of the District Registrar or other prescribed authority, the prescribed fee and self-attested documentation. A registration delayed beyond one year requires an order of the District Magistrate, Sub-Divisional Magistrate or an authorised Executive Magistrate having jurisdiction, along with the prescribed fee.
Section 17 permits a person, subject to applicable rules and fees, to have the register searched and to obtain a birth or death certificate electronically or otherwise. A death certificate issued under this section does not disclose the registered particulars concerning the cause of death.
