Current legal framework for birth registration in India
Birth registration in India is governed by the Registration of Births and Deaths Act, 1969, as amended by the Registration of Births and Deaths (Amendment) Act, 2023. The 2023 amendments came into force on 1 October 2023 and introduced, among other changes, digital registration and electronic delivery of birth and death certificates.
- Births must be reported to the competent Registrar by the persons responsible under the Act.
- Under the Model Registration of Births and Deaths Rules, information concerning a birth is ordinarily reported within 21 days.
- Delayed registration is governed by section 13 of the Act and the applicable State or Union Territory rules.
- For persons born on or after 1 October 2023, the amended law provides for use of the birth certificate as a single document to prove date and place of birth for specified statutory purposes.
