Important: An online grievance, citizen tip or general complaint is not necessarily the same as registration of an FIR. If the information discloses a cognizable offence, FIR registration is governed by Section 173 BNSS and the applicable police procedure.

Current law for FIR registration: Section 173 BNSS

The Bharatiya Nagarik Suraksha Sanhita, 2023 replaced the Code of Criminal Procedure for the relevant procedure with effect from 1 July 2024. Section 173 deals with information relating to cognizable offences.

Key rule: Information about a cognizable offence may be given orally or by electronic communication to the officer in charge of a police station, irrespective of the area where the offence was committed. Electronic information is taken on record when signed by the informant within three days.
  • Zero FIR: Territorial jurisdiction is not a ground to refuse information about a cognizable offence at the initial stage. The matter can subsequently be transferred to the appropriate police station.
  • Electronic communication: Section 173 expressly recognises information given electronically, subject to the statutory signing requirement.
  • Free copy: Under Section 173(2), a copy of the recorded information is to be given forthwith, free of cost, to the informant or victim.
  • If information is not recorded: Section 173 provides further remedies, including approaching the Superintendent of Police and, where applicable, the Magistrate in accordance with law.

How to report a cognizable offence to Kolkata Police

For an emergency, contact police immediately Do not rely on a web form in an emergency. Kolkata Police currently lists Control Room numbers 100 / 1090, Women in Need 1091 and National Cyber Crime Helpline 1930 among its official helplines.
Give complete information about the offence State the date, time, place, persons involved, sequence of events, known witnesses and available documents, photographs, video or other electronic material. Keep the facts accurate and chronological.
You may approach a police station even if the incident occurred elsewhere Section 173 BNSS uses the words "irrespective of the area where the offence is committed." This is the statutory basis relevant to Zero FIR practice.
If information is sent electronically, complete the signing requirement Electronic information must be signed by the informant within three days for it to be taken on record under Section 173(1)(ii) BNSS.
Obtain the FIR / recorded information copy Once an FIR has been registered, use the official Kolkata Police Bondhu FIR service where available, or obtain the free copy to which the informant or victim is entitled under Section 173(2) BNSS.

West Bengal Police citizen services

For services outside or in addition to the Kolkata Police Bondhu portal, the West Bengal Police Citizen Portal provides citizen-facing CCTNS services such as FIR view/copy and information to the local police station. The portal itself distinguishes grievance/intimation services from formal legal use, so users should follow up with the concerned police station where FIR registration is required.

False or fabricated information

Do not submit false, fabricated or malicious allegations. The Bharatiya Nyaya Sanhita, 2023 contains offences relating to false information given with intent to cause a public servant to use lawful power to the injury of another person, among other applicable offences. The West Bengal Police citizen portal also warns that legal steps may be taken for false or fabricated information.

Can I file a Zero FIR in Kolkata?

Section 173(1) BNSS permits information relating to a cognizable offence to be given to a police station irrespective of where the offence occurred. The jurisdictional transfer can be dealt with after the information is recorded in accordance with law.

Is an online complaint automatically an FIR?

No. A grievance, tip or online complaint does not automatically become an FIR merely because it was submitted online. Whether an FIR must be registered depends on whether the information discloses a cognizable offence and on compliance with the statutory procedure.

Can information about a cognizable offence be sent electronically?

Yes. Section 173(1)(ii) BNSS recognises electronic communication, but the information must be signed by the informant within three days for it to be taken on record.
