Section 3D of Central Universities Act, 2009 - Central Tribal University of Andhra Pradesh
Section 3D provides for the establishment of the Central Tribal University of Andhra Pradesh as a Central University with State-wide territorial jurisdiction and a special statutory focus on higher education and research for the tribal population of India.
Text and effect of Section 3D
Section 3D - Establishment of Central Tribal University of Andhra Pradesh.
There shall be established a Tribal University, which shall be a body corporate, to be known as the Central Tribal University of Andhra Pradesh, having its territorial jurisdiction extending to the whole of the State of Andhra Pradesh, as specified in the First Schedule to the Act, to provide avenues of higher education and research facilities primarily for the tribal population of India.
Meaning of the provision
Section 3D creates the Central Tribal University of Andhra Pradesh by statute. The expression body corporate means that the University has a separate legal identity under the Central Universities Act, 2009 and functions through the statutory framework applicable to Central Universities.
The provision also expressly extends the University's territorial jurisdiction to the whole State of Andhra Pradesh. Its distinctive statutory purpose is to provide higher education and research facilities primarily for the tribal population of India.
When Section 3D came into force
Section 3D was inserted by section 2 of the Central Universities (Amendment) Act, 2019 (Act 15 of 2019), with effect from 5 August 2019. The same amendment also inserted Section 3C relating to the Central University of Andhra Pradesh.
Related statutory objective under Section 5
Section 5 of the Central Universities Act sets out the general objects of Central Universities. A special proviso applicable to the Tribal University established under Section 3D requires additional attention to tribal-centric higher education and research, including matters concerning tribal art, culture, customs, traditions, medicinal systems, languages, forest-based economic activities, flora and fauna, and related areas.
