This page is intentionally confined to the IPC position applicable before that commencement and may remain relevant to offences governed by the earlier law.

What does Section 376 IPC provide?

Section 376 does not itself contain the complete definition of rape. The offence is defined by Section 375 IPC, while Section 376 prescribes punishment according to the nature of the offence and the circumstances in which it is committed.

Section 376(1) IPC - General punishment for rape

The minimum term in Section 376(1) was increased from seven years to ten years by the Criminal Law (Amendment) Act, 2018, with effect from 21 April 2018.

Section 376(2) IPC - Aggravated circumstances

Sub-section (2) provides enhanced punishment where rape is committed in specified aggravated circumstances. These include the following statutory categories:

The punishment under Section 376(2) is rigorous imprisonment for not less than ten years, which may extend to imprisonment for life meaning imprisonment for the remainder of the offender's natural life, along with fine.

Definitions used in Section 376(2)

Expression Meaning for Section 376(2)
Armed forces Naval, military and air forces, including members of armed forces constituted under law, paramilitary forces and auxiliary forces under the control of the Central Government or State Government.
Hospital The precincts of a hospital and institutions for reception and treatment during convalescence or for persons requiring medical attention or rehabilitation.
Police officer The expression is linked by the IPC explanation to the meaning assigned to "police" under the Police Act, 1861.
Women's or children's institution An institution established and maintained for the reception and care of women or children, including an orphanage, home for neglected women or children, widow's home, or an institution known by another name.

Section 376(3) IPC - Rape of a woman under sixteen years

Section 376(3), inserted by the Criminal Law (Amendment) Act, 2018 with effect from 21 April 2018, provides a minimum punishment of twenty years' rigorous imprisonment where rape is committed upon a woman under sixteen years of age. The sentence may extend to imprisonment for life, meaning imprisonment for the remainder of the offender's natural life, and the offender is also liable to fine.

The fine must be just and reasonable to meet the medical expenses and rehabilitation of the victim, and any fine imposed under this sub-section is to be paid to the victim.

How Section 375 and Section 376 work together

Section 375 IPC sets out the acts and circumstances constituting rape, including the rules relating to consent and age. Section 376 supplies the punishment. Therefore, the ingredients of the offence are ordinarily examined under Section 375 before the applicable punishment is identified under Section 376 or another specific provision in the Section 376 series.

Child victims and the POCSO Act

Where the victim is below eighteen years of age, the Protection of Children from Sexual Offences Act, 2012 may also apply according to the facts. That Act separately defines and punishes penetrative sexual assault and aggravated penetrative sexual assault. The applicability of the IPC and the POCSO Act must be assessed with reference to the date and facts of the alleged offence.

Related offences in the Section 376 series

The IPC contained separate provisions for specified sexual offences and aggravated forms of rape, including Section 376A, Section 376AB, Section 376B, Section 376C, Section 376D, Section 376DA, Section 376DB and Section 376E.

Important amendment history

The Criminal Law (Amendment) Act, 2013 substantially restructured the law relating to rape and sexual offences. The Criminal Law (Amendment) Act, 2018 further increased punishment in Section 376(1), omitted the former clause (i) of Section 376(2), inserted Section 376(3), and introduced additional provisions dealing with rape and gang rape of victims below specified ages.

The law applicable to a particular case depends on the date of the alleged offence, the facts, amendments in force at the relevant time, and applicable special laws.
