Section 376D IPC: Gang Rape Meaning Punishment and Law
Section 376D of the Indian Penal Code, 1860 dealt with gang rape. Where a woman was raped by one or more persons constituting a group or acting in furtherance of a common intention, the section deemed each such person to have committed the offence of rape and prescribed a minimum sentence of twenty years' rigorous imprisonment.
Section 376D IPC - Statutory Provision
376D. Gang rape. Where a woman is raped by one or more persons constituting a group or acting in furtherance of a common intention, each of those persons shall be deemed to have committed the offence of rape and shall be punished with rigorous imprisonment for a term which shall not be less than twenty years, but which may extend to life which shall mean imprisonment for the remainder of that person's natural life, and with fine:
Provided that such fine shall be just and reasonable to meet the medical expenses and rehabilitation of the victim:
Provided further that any fine imposed under this section shall be paid to the victim.
Meaning of Gang Rape Under Section 376D IPC
Section 376D created group liability for rape in the circumstances stated in the provision. The section applied where a woman was raped by one or more persons who constituted a group or acted in furtherance of a common intention. Its deeming clause made each person satisfying those statutory conditions liable as having committed rape.
The underlying offence of rape was defined by Section 375 IPC. Section 376D had to be read with that definition when determining whether the sexual act amounted to rape and whether the group or common-intention requirement was established.
Essential Ingredients of Section 376D IPC
For liability under Section 376D, the prosecution was required to establish the ingredients of the provision on the evidence in the case. The principal statutory elements were:
- a woman was raped within the meaning of Section 375 IPC;
- one or more persons constituted a group, or acted in furtherance of a common intention;
- the accused sought to be held liable fell within that group or common-intention requirement; and
- because of the deeming provision, each person satisfying those requirements was treated as having committed rape.
Does Every Member of the Group Have to Personally Commit the Act of Rape?
The wording of Section 376D was broader than liability based only on the physical act of penetration by each accused. Once the statutory requirements concerning the group and furtherance of common intention were established, the section expressly deemed each such person to have committed rape. Whether those requirements were proved remained a question to be determined from the facts and evidence of the individual case.
Punishment Under Section 376D IPC
The punishment prescribed by Section 376D was rigorous imprisonment for a term of not less than twenty years. The sentence could extend to imprisonment for life, and the section expressly stated that such life imprisonment meant imprisonment for the remainder of that person's natural life. Fine was also mandatory under the wording of the provision.
| Provision | Section 376D, Indian Penal Code, 1860 |
|---|---|
| Offence | Gang rape |
| Minimum punishment | Rigorous imprisonment for not less than twenty years |
| Maximum punishment | Imprisonment for life, meaning imprisonment for the remainder of the offender's natural life |
| Fine | Fine must be just and reasonable to meet the medical expenses and rehabilitation of the victim and must be paid to the victim |
| Cognizability | Cognizable |
| Bail classification | Non-bailable |
| Court competent to try | Court of Session |
Fine for Medical Expenses and Rehabilitation
Section 376D imposed two express requirements concerning fine. The fine had to be just and reasonable to meet the medical expenses and rehabilitation of the victim, and any fine imposed under the section had to be paid to the victim. These were statutory components of the sentencing provision.
Cognizable and Non-Bailable Offence
Under the pre-BNSS Code of Criminal Procedure framework, an offence under Section 376D was cognizable and non-bailable and was triable by a Court of Session. The Code of Criminal Procedure also contained special procedural safeguards for specified sexual offences, including provisions concerning recording the victim's statement and investigation.
Section 376D and Common Intention
The phrase "acting in furtherance of a common intention" was built directly into Section 376D. The statutory focus was therefore not confined to whether every accused personally performed the same physical act. The prosecution nevertheless had to prove the factual basis connecting the particular accused to the group conduct or common intention required by the section.
Section 376D Compared With Sections 376DA and 376DB
Section 376D was the general IPC provision for gang rape. The Criminal Law (Amendment) Act, 2018 introduced separate aggravated provisions based on the victim's age. Section 376DA IPC addressed gang rape on a woman under sixteen years of age, while Section 376DB IPC addressed gang rape on a woman under twelve years of age.
Criminal Law Amendment Act 2013 and Section 376D
The modern form of Section 376D was substituted as part of the Criminal Law (Amendment) Act, 2013, which substantially revised the IPC provisions relating to rape and sexual offences. The substituted provision established the specific statutory framework for gang rape, including the group-liability deeming clause, the minimum punishment and the victim-focused fine provisions.
