Section 376A IPC: Punishment for Causing Death or Persistent Vegetative State of Victim
Section 376A of the Indian Penal Code, 1860 prescribed an enhanced punishment where, during the commission of rape punishable under Section 376(1) or Section 376(2), the offender inflicted an injury that caused the death of the woman or caused her to be in a persistent vegetative state.
What is Section 376A of the Indian Penal Code?
Section 376A addressed a particularly grave consequence of rape. It applied when a person committed an offence punishable under sub-section (1) or sub-section (2) of Section 376 IPC and, in the course of that offence, inflicted an injury that either caused the woman's death or caused her to enter a persistent vegetative state.
The underlying definition of rape was contained in Section 375 IPC. Section 376A operated as an aggravated punishment provision based on the consequence of the injury inflicted during the offence.
Text and effect of Section 376A IPC
Section 376A - Punishment for causing death or resulting in persistent vegetative state of victim
Where a person commits an offence punishable under Section 376(1) or Section 376(2), and in the course of its commission inflicts an injury which causes the death of the woman or causes the woman to be in a persistent vegetative state, Section 376A provides rigorous imprisonment for not less than twenty years.
The sentence may extend to imprisonment for life, meaning imprisonment for the remainder of that person's natural life, or to death.
Essential ingredients of Section 376A IPC
For Section 376A to apply, the statutory elements include an offence punishable under Section 376(1) or Section 376(2), an injury inflicted in the course of committing that offence, and a specified consequence of that injury: either the death of the woman or a persistent vegetative state.
| Ingredient | Requirement under Section 376A |
|---|---|
| Underlying offence | An offence punishable under Section 376(1) or Section 376(2) IPC |
| Conduct during offence | The offender inflicts an injury in the course of commission of the offence |
| Required consequence | The injury causes the death of the woman or causes her to be in a persistent vegetative state |
| Minimum sentence | Rigorous imprisonment for not less than 20 years |
| Life sentence | May extend to imprisonment for the remainder of the offender's natural life |
| Death penalty | Death is also a punishment permitted by the section |
Classification under the Code of Criminal Procedure, 1973
Under the First Schedule to the Code of Criminal Procedure, 1973, the offence under Section 376A IPC was cognizable and non-bailable and was triable by the Court of Session.
| Nature | Cognizable |
|---|---|
| Bail classification | Non-bailable |
| Trial court | Court of Session |
| Punishment | Rigorous imprisonment of not less than 20 years, extendable to imprisonment for the remainder of natural life, or death |
Meaning of persistent vegetative state
Section 376A used the expression "persistent vegetative state" as one of the consequences that trigger the enhanced punishment. The provision itself did not set out a separate definition of that expression. Whether the statutory consequence is established in an individual prosecution therefore depends on the evidence placed before the court, including the relevant medical evidence.
Section 376A and related rape provisions
Section 376A should be read with the structure of the IPC provisions on sexual offences. Section 375 defined rape, while Section 376 prescribed the principal punishments for rape. Other provisions dealt with distinct aggravated circumstances, including Section 376AB for rape of a woman under twelve years, Section 376D for gang rape, Section 376DA and Section 376DB for specified gang-rape offences involving younger victims, and Section 376E for repeat offenders.
Arunachal Pradesh state amendment
State-specific provision: The Criminal Laws (Arunachal Pradesh Amendment) Act, 2018, published as Arunachal Pradesh Act 3 of 2019, made amendments to the IPC in its application to Arunachal Pradesh. The uploaded page records the insertion of Section 376AA after Section 376A and a state amendment concerning Section 376DA.
Section 376AA - Arunachal Pradesh
The state amendment provided a specific punishment for rape of a woman up to twelve years of age: death, or rigorous imprisonment for a term of not less than fourteen years which could extend to imprisonment for life for the remainder of the offender's natural life, together with liability to fine.
State amendment concerning Section 376DA
The amendment also contained a provision concerning gang rape of a woman up to twelve years of age, prescribing death or rigorous imprisonment of not less than twenty years, extendable to imprisonment for the remainder of natural life, together with fine. It further provided that the fine should be just and reasonable to meet the victim's medical expenses and rehabilitation and should be paid to the victim.
