Section 376E IPC: Punishment for Repeat Sexual Offenders

Section 376E of the Indian Penal Code, 1860 prescribed an enhanced punishment for a person who had previously been convicted of specified serious rape offences and was subsequently convicted of another offence punishable under any of the specified sections.

Legal scope of this article: This page explains Section 376E IPC and the connected criminal procedure as applicable before the Bharatiya Nyaya Sanhita, 2023 came into force on 1 July 2024. It is intended for understanding the pre-BNS legal position and matters governed by the earlier law.

Section 376E IPC - Statutory Provision

376E. Punishment for repeat offenders. Whoever has been previously convicted of an offence punishable under section 376 or section 376A or section 376AB or section 376D or section 376DA or section 376DB, and is subsequently convicted of an offence punishable under any of the said sections shall be punished with imprisonment for life which shall mean imprisonment for the remainder of that person's natural life, or with death.

Meaning of Repeat Offender Under Section 376E IPC

Section 376E was a repeat-conviction provision. It did not apply merely because a person faced more than one allegation. Its text required a previous conviction for one of the specified offences and a subsequent conviction for an offence punishable under any of those specified sections.

Essential Requirements of Section 376E

  • there must have been a previous conviction of the accused;
  • the previous conviction must have been for an offence punishable under one of the sections specifically listed in Section 376E;
  • there must thereafter be a subsequent conviction;
  • the subsequent conviction must also be for an offence punishable under one of the listed sections; and
  • once these statutory conditions are satisfied, Section 376E prescribes the enhanced punishment stated in the provision.

Which IPC Offences Were Covered by Section 376E?

After the Criminal Law (Amendment) Act, 2018, Section 376E covered qualifying previous and subsequent convictions under the following IPC provisions:

Section 376 Punishment for rape
Section 376A Punishment for causing death or resulting in persistent vegetative state of victim
Section 376AB Punishment for rape on woman under twelve years of age
Section 376D Gang rape
Section 376DA Gang rape on woman under sixteen years of age
Section 376DB Gang rape on woman under twelve years of age

Punishment Under Section 376E IPC

Section 376E prescribed two sentencing alternatives: imprisonment for life, expressly defined as imprisonment for the remainder of the offender's natural life, or death. The provision therefore applied an enhanced sentencing regime to qualifying repeat offenders.

Provision Section 376E, Indian Penal Code, 1860
Nature of provision Enhanced punishment for qualifying repeat offenders
Punishment Imprisonment for life for the remainder of the offender's natural life, or death
Cognizability Cognizable
Bail classification Non-bailable
Court competent to try Court of Session

Previous Conviction and Subsequent Conviction

The sequence required by Section 376E is important. The statutory language refers first to a person who "has been previously convicted" and then to that person being "subsequently convicted." The enhanced punishment therefore depends upon the existence of the qualifying earlier conviction followed by a qualifying later conviction.

Criminal Law Amendment Act 2013

Section 376E was introduced through the Criminal Law (Amendment) Act, 2013 as part of the substantial revision of the IPC provisions concerning rape and sexual offences. As originally introduced, the repeat-offender provision referred to Sections 376, 376A and 376D.

Expansion by the Criminal Law Amendment Act 2018

The Criminal Law (Amendment) Act, 2018 expanded Section 376E. Section 7 of that amending Act substituted the earlier reference to Section 376D so that the list also included Sections 376AB, 376DA and 376DB. The amendment took effect from 21 April 2018.

Procedural Classification Before BNSS

Under the First Schedule to the Code of Criminal Procedure, 1973, Section 376E was classified as cognizable and non-bailable and was triable by a Court of Session. These are the procedural classifications relevant to the pre-BNSS legal framework addressed by this article.

Chhattisgarh State Amendment - Section 376F

The source page also records a Chhattisgarh State amendment inserting Section 376F after Section 376E. The State provision concerns liability of a person in charge of a workplace, or another person present there, who has knowledge that an offence under Section 376 or Section 376D is being committed and, while in a position to prevent it, fails to prevent it or to give information to a Magistrate or police officer with the intention of screening the offender from legal punishment.

The State provision further explains that "work-place" includes a mode of transport owned, hired or otherwise engaged by the person in charge of the workplace for conveying the woman to and from her residence and workplace. The uploaded page attributes this amendment to Chhattisgarh Act 25 of 2015.
