First, Second, Third, Fourth and Fifth Schedules of the Special Marriage Act, 1954

The five schedules prescribe prohibited relationships, the notice of intended marriage, declarations by the parties, and certificates for marriages solemnized or registered under the Special Marriage Act, 1954 (Act 43 of 1954).

The schedules must be read with the corresponding provisions of the Act. Section 2(b) defines degrees of prohibited relationship; section 5 governs notice of intended marriage; section 11 requires declarations by the parties and three witnesses; section 13 governs the certificate of solemnization; and section 16 governs registration certificates for marriages celebrated in other forms.

First Schedule: Degrees of prohibited relationship (section 2(b))

Under section 4(d), the parties must not be within the prohibited degrees of relationship unless a custom governing at least one party permits such a marriage. The statutory definition includes relationships by full, half or uterine blood, by adoption, and legitimate or illegitimate blood relationship.

Explanation.-For the purposes of this Part, the expression "widow" includes a divorced wife.

Second Schedule: Notice of intended marriage (section 5)

Section 5 requires written notice in the prescribed form to the Marriage Officer of the district in which at least one party has resided for not less than thirty days immediately preceding the notice. Section 14 generally requires a fresh notice if the marriage is not solemnized within the statutory three-month period, subject to the appeal and decision provisions stated there.

3. I am not related to C.D. (the bride) within the degrees of prohibited relationship.

4. I am aware that, if any statement in this declaration is false, and if in making such statement I either know or believe it to be false or do not believe it to be true, I am liable to imprisonment and also to fine.

* Herein give particulars of the parties.

Related conditions: Section 4 requires neither party to have a living spouse, sets minimum ages of 21 years for the male and 18 years for the female, and contains conditions concerning capacity to consent and prohibited relationships. Section 15 sets separate conditions for registering marriages already celebrated in other forms. Consult the Act and applicable state rules for procedure and fees.
