Income-tax deduction under section 133

For tax years governed by the Income-tax Act, 2025, donations to specified funds are dealt with under section 133. Section 133(1)(a)(xv) covers a Chief Minister's Relief Fund where the fund is the only fund of its kind established in the State or Union territory, is under the overall control of the Chief Secretary or the Finance Department, and is administered in the manner specified by the State Government or Lieutenant Governor.

A fund satisfying those conditions falls within the category for deduction of the whole qualifying donation. The 10% adjusted-gross-total-income restriction applies only to the categories specifically covered by section 133(2) and does not include a qualifying Chief Minister's Relief Fund under section 133(1)(a)(xv).

Section 133(5) further provides that where a donation exceeds ₹2,000, deduction is available only if payment is made by a mode other than cash.

Section 80G and earlier assessment years

That provision remains relevant for assessment years governed by the Income-tax Act, 1961. For tax years governed by the Income-tax Act, 2025, the corresponding donation-deduction provision is section 133.

The official Nagaland CMRF page states that donors using RTGS, NEFT, UPI/VPA, QR code, cheque, draft or similar modes may email a screenshot or proof of payment. Receipts are generated after reconciliation with the bank and sent by email.
