Section 49: Functions of Polling Agents and Counting Agents - Representation of the People Act, 1951
Section 49 of the Representation of the People Act, 1951 specifies the statutory authority of polling agents and counting agents. Their functions are not unlimited: each agent may act only to the extent permitted by the Act and the applicable election rules.
Section 49: Statutory provision
(1) A polling agent may perform such functions in connection with the poll as are authorised by or under this Act to be performed by a polling agent.
(2) A counting agent may perform such functions in connection with the counting of votes as are authorised by or under this Act to be performed by a counting agent.
Meaning and scope of Section 49
Polling agent: A representative appointed by a contesting candidate or the candidate's election agent under Section 46 to observe and perform authorised functions at a polling station. The polling agent helps monitor whether polling procedures are followed, but does not replace the presiding officer or exercise independent control over the poll.
Counting agent: A representative appointed under Section 47 to observe and perform authorised functions during the counting of votes. The counting agent may scrutinise the counting process and raise objections through the procedures provided by law, but cannot interfere with counting officials.
Functions of a polling agent
- Attend the polling station as permitted under the Conduct of Elections Rules, 1961, subject to the required appointment documents and identification.
- Observe identification and voting procedures, including the statutory safeguards against impersonation and irregular voting.
- Exercise procedural rights available to polling agents, including challenges to voter identity and participation in sealing-related procedures where the applicable rules so provide.
- Observe the close of poll and relevant records and seals in accordance with instructions and the applicable rules.
For example, the challenge to the identity of a voter is governed by Rule 49J of the Conduct of Elections Rules, 1961 in elections conducted using electronic voting machines. The prescribed procedure and deposit requirements must be followed; an agent cannot reject a voter merely on suspicion.
Functions of a counting agent
- Attend the authorised counting place and observe the counting process, subject to entry and identification requirements.
- Inspect the proceedings to the extent allowed under the Conduct of Elections Rules, 1961 and directions of the Returning Officer.
- Draw attention to apparent discrepancies and make requests or objections using the prescribed procedures.
- Observe preparation of counting results and associated documentation, without handling voting equipment or ballot papers except where expressly permitted.
Relevant counting procedures include Rules 53 to 56 for ballot-paper counting and Rule 66A and the applicable provisions of Rules 55C and 56C for electronic voting machine counting, as relevant to the type of election and voting method. Counting agents must also comply with lawful directions controlling access and order in the counting hall.
Limits on an agent's authority
Section 49 is an enabling provision, not a general licence to direct polling or counting officials. Appointment under Sections 46 or 47 does not itself create a power to interrupt voting, handle EVMs, demand access to confidential votes or disregard election instructions. Voting secrecy, security, authorised access and the prescribed procedures remain applicable.
