Section 47: Appointment of Counting Agents

Section 47 of the Representation of the People Act, 1951 authorises a contesting candidate or the candidate's election agent to appoint counting agents to attend and observe the counting of votes. The appointment, permissible number, prescribed form and notice to the returning officer are governed by the Act and the Conduct of Elections Rules, 1961.

Key rule: Appointments are made in Form 18 under Rule 52. Subject to Election Commission directions, the statutory-rule ceiling is 16 counting agents per counting place, not an unconditional entitlement to 16 agents at every counting table. The returning officer controls placement and admission.

Meaning and legal scope of Section 47

Section 47 permits a contesting candidate (a candidate whose name appears on the final list of contesting candidates) or that candidate's duly appointed election agent to appoint one or more persons as counting agents, up to the prescribed maximum. Notice of appointment must be furnished to the returning officer in the prescribed manner. A counting agent is the candidate's authorised representative for observing the vote-counting process; appointment does not confer power to direct election officials or interfere with counting.

Rule 52: How counting agents are appointed

  1. Identify the permitted number: Under Rule 52(1), the number appointed may not exceed 16 at each counting place, subject to any general or special direction issued by the Election Commission of India. Confirm the actual permissible allocation with the returning officer for the election concerned.
  2. Complete Form 18 in duplicate: Under Rule 52(2), the candidate or election agent must execute the prescribed appointment form identifying the agents and the counting venue. Forward one copy to the returning officer and give the other to the appointed agent.
  3. Present the form on time: The agent must produce the second copy to the returning officer not later than one hour before the time fixed for counting under Rule 51.
  4. Complete the declaration: Under Rule 52(3), the counting agent must deliver the second copy, complete and sign the prescribed declaration, and receive the returning officer's authority for entry. Merely being named in Form 18 does not authorise admission.

Where counting agents may sit or observe

Rule 51 provides for the returning officer to fix and notify the counting location, date and time. Under Rule 53, the returning officer regulates admission to the counting venue and determines which counting agents may watch counting at particular tables or groups of tables. Candidates, their election agents and duly appointed counting agents are among the categories permitted admission, subject to the applicable rules, security arrangements and lawful directions.

Under Rule 50(c), for the purposes of Part V of the Conduct of Elections Rules, a counting agent includes the candidate and the election agent when present at counting. This definition does not remove the need for other persons appointed as counting agents to comply with Rule 52.

Responsibilities and limits of counting agents

Counting agents can observe counting proceedings, monitor the process relevant to their assigned counting area and bring perceived irregularities to the appropriate election official. They must maintain order, comply with lawful directions and respect the secrecy of voting. Section 128 of the Act protects the secrecy of voting; the declaration in Form 18 expressly refers to this obligation. Rule 53(4) permits removal of a person who misbehaves or fails to obey lawful directions.

Revocation, death and replacement

Section 48 deals with revocation or death of polling and counting agents. Under Rule 52(4), revocation of a counting agent's appointment is made in Form 19 and lodged with the returning officer. If revocation occurs before counting commences, Rule 52(5) allows a fresh appointment following Rule 52(2). Check Section 48 and current election instructions where death or a later vacancy is involved.

Checklist before counting day

  • Confirm the counting venue, reporting time and any applicable Election Commission directions.
  • Verify how many agents are authorised for the particular venue or counting tables.
  • Prepare and sign Form 18 in duplicate and deliver the required copy to the returning officer.
  • Ensure every agent brings the second copy, completes the declaration and obtains entry authority within the prescribed time.
  • Brief agents on secrecy of voting, observation duties and lawful directions of election officials.
