Lost Item Report Is Not the Same as an FIR
A lost-item report generally records the loss of an article or document. It should not be used as a substitute for an FIR where the facts indicate that property was stolen.
- Accidentally losing a wallet may be reported as a lost article.
- A wallet taken from your possession without consent may involve theft.
- A lost mobile phone may be reported through e-Lost where appropriate.
- If a phone was snatched or stolen, the circumstances should be reported as a suspected criminal offence.
What if the Lost Item Was Actually Stolen?
If you later discover that the item was stolen, or the circumstances indicate theft, contact the concerned police station and provide the earlier loss-report details.
The current criminal law is the Bharatiya Nyaya Sanhita, 2023. Section 303 deals with theft. The applicable criminal procedure is governed by the Bharatiya Nagarik Suraksha Sanhita, 2023.
Reporting Theft or Other Cognizable Offences
Section 173 BNSS provides that information relating to a cognizable offence may be given orally or by electronic communication to the officer in charge of a police station, irrespective of the area where the offence occurred.
Electronic information is taken on record after being signed by the person giving it within three days.
