Law Governing Hindu Marriage Registration in Kerala

Principal law: Hindu Marriage Act, 1955
Relevant provision: Section 8 - Registration of Hindu marriages
Kerala rules: Kerala Hindu Marriage Registration Rules, 1957

Section 8 of the Hindu Marriage Act, 1955 empowers State Governments to provide for registration of Hindu marriages and maintenance of a Hindu Marriage Register. Kerala's official Local Self Government Department service material identifies the Kerala Hindu Marriage Registration Rules, 1957 as the State rules governing Hindu marriage registration and marriage-certificate services.

Registration and proof of marriage

Registration creates an official record of the marriage and facilitates proof of the marriage. The validity and solemnisation of a Hindu marriage continue to be governed by the substantive provisions of the Hindu Marriage Act, 1955, including the conditions and ceremonies applicable to the marriage.

Delayed Hindu Marriage Registration in Kerala

Kerala's official service-rights material specifically provides for delayed registration of a Hindu marriage where the marriage could not be registered within the prescribed period. The applicable permission, fee, registrar and supporting-document requirements should be checked on K-SMART or with the concerned Local Registrar before filing.

The official Kerala service material also separately recognises registration and certificate services under the Kerala Hindu Marriage Registration Rules, 1957.

Hindu Marriage Registration and Common Marriage Registration

Kerala has more than one marriage-registration framework. A Hindu marriage may be registered under the Hindu Marriage Act, 1955 and the Kerala Hindu Marriage Registration Rules, 1957. Kerala also has the Kerala Registration of Marriages (Common) Rules, 2008, which provide a separate common marriage-registration mechanism. The correct service should be selected based on the marriage and the registration sought.
