Commercial Courts Act, 2015 - Jurisdiction, Specified Value, Mediation, Arbitration and Appeals
The Commercial Courts Act, 2015 (Act No. 4 of 2016) provides the framework for Commercial Courts, Commercial Appellate Courts, Commercial Divisions and Commercial Appellate Divisions for adjudication of commercial disputes of specified value.
The Act covers commercial disputes arising from transactions such as mercantile documents, banking and financial services, construction and infrastructure contracts, intellectual property, insurance, partnership agreements, technology agreements and agreements for sale of goods or provision of services, subject to the statutory definition in Section 2.
Its procedural framework is designed for specialised and time-efficient adjudication. It also modifies the application of the Code of Civil Procedure, 1908 to commercial disputes and contains specific provisions governing arbitration matters, appeals, transfer of pending cases, case management and pre-institution mediation.
