Section 17 of the Central Universities Act, 2009 - Librarian
Section 17 of the Central Universities Act, 2009 deals with the appointment, service conditions, powers and duties of the Librarian of a University governed by the Act.
Text and meaning of Section 17
Section 17 - Librarian: The Librarian shall be appointed in such manner and on such terms and conditions of service, and shall exercise such powers and perform such duties, as may be prescribed by the Statutes.
In practical terms, Section 17 does not itself prescribe a detailed recruitment procedure, tenure, salary structure or complete list of functions for the Librarian. Instead, it makes the applicable University Statutes the governing source for those details.
What Section 17 covers
Appointment of the Librarian
The appointment must be made in the manner prescribed by the Statutes applicable to the University. The relevant Statutes should therefore be consulted for the competent appointing authority, selection procedure, qualifications and other appointment requirements.
Terms and conditions of service
The Librarian's service conditions are also governed by the Statutes. Depending on the applicable statutory framework, these may address matters such as tenure, pay, leave, retirement, service benefits and other conditions attached to the office.
Powers and duties
Section 17 further provides that the Librarian shall exercise the powers and perform the duties prescribed by the Statutes. The precise institutional functions must therefore be read with the Statutes governing the particular Central University.
Meaning of "Statutes" under the Act
For Section 17, the expression "Statutes" refers to the Statutes made or continued under the Central Universities Act, 2009 for regulating matters assigned to them by the Act. Accordingly, Section 17 should be read together with the applicable statutory provisions rather than as a stand-alone service rule.
