Meaning of Important Expressions

Voluntarily Vitiates the Atmosphere

The section uses the expression "voluntarily vitiates". The prohibited conduct therefore requires a voluntary act that degrades or contaminates the surrounding atmosphere in the manner described by the provision.

Noxious to Health

The statutory test is whether the atmosphere is made noxious to the health of the persons described in the section. The provision is concerned with harmful atmospheric conditions affecting people generally in the relevant area, rather than a purely private inconvenience with no such health-related character.

Neighbourhood and Public Way

Section 280 expressly extends protection to persons generally dwelling or carrying on business in the neighbourhood and to persons passing along a public way. Whether a particular incident satisfies this requirement will depend on the location, nature of the conduct and evidence regarding its effect.

Punishment and Classification

The punishment under Section 280 is a fine which may extend to Rs. 1,000. Under the First Schedule to the Bharatiya Nagarik Suraksha Sanhita, 2023, the offence is non-cognizable, bailable and triable by any Magistrate.

When Section 280 May Apply

The section may apply where a person voluntarily causes fumes, smoke, gases, vapours, offensive emissions or similar atmospheric contamination in circumstances that make the atmosphere noxious to the health of persons generally in the neighbourhood or persons using a public way. Whether the provision is attracted depends on the facts and the evidence in each case.
