RESIDENTIAL RENT AGREEMENT
This Rent Agreement is made at ________________ on ____ / ____ / 20____.
BETWEEN
Mr./Ms. ______________________________, son/daughter/spouse of ______________________________, residing at ____________________________________________________________, hereinafter referred to as the "Landlord" (which expression shall, unless repugnant to the context, include his/her lawful heirs, legal representatives, successors and permitted assigns), of the First Part;
AND
Mr./Ms. ______________________________, son/daughter/spouse of ______________________________, presently residing at ____________________________________________________________, hereinafter referred to as the "Tenant" (which expression shall, unless repugnant to the context, include his/her lawful representatives and permitted assigns), of the Second Part.
Recitals
A. The Landlord represents that he/she is lawfully entitled to let out the residential premises situated at ____________________________________________________________, together with the fixtures, fittings and amenities described in this Agreement ("Premises").
B. The Tenant has requested the Landlord to permit occupation of the Premises solely for residential use, and the Landlord has agreed on the following terms.
Terms and Conditions
- Term: The tenancy shall commence on ____ / ____ / 20____ and continue until ____ / ____ / 20____, unless terminated earlier in accordance with this Agreement and applicable law. Any renewal shall be by written agreement between the parties.
- Monthly rent: The Tenant shall pay rent of ₹____________ (Rupees ________________________________ only) per month on or before the ____ day of each calendar month by ________________ or another mutually agreed mode.
- Security deposit: The Tenant has paid ₹____________ as an interest-free security deposit, receipt of which the Landlord acknowledges. Subject to lawful deductions for unpaid dues or damage beyond normal wear and tear, the balance shall be refunded after vacant possession, keys and agreed clearances are handed over. Any State/UT statutory limit on security deposits shall prevail.
- Use: The Premises shall be used only for lawful residential purposes by the Tenant and the following permitted occupants: ____________________________________________________________.
- No subletting or transfer: The Tenant shall not sublet, license, assign or part with possession of the whole or any part of the Premises without the Landlord's prior written consent and compliance with applicable law.
- Electricity, water and other charges: The Tenant shall pay charges for electricity, water, piped gas, internet and other consumption-based services used during the tenancy, unless otherwise stated here: ____________________________________________________________. Property tax and ownership-related statutory dues shall be borne by the Landlord unless lawfully agreed otherwise.
- Maintenance and repairs: Routine day-to-day upkeep attributable to the Tenant's use shall be borne by the Tenant. Structural repairs and ownership-related major repairs shall ordinarily be the Landlord's responsibility, subject to the applicable law and any specific written allocation below: ____________________________________________________________.
- Alterations: The Tenant shall not make structural alterations or permanent additions without the Landlord's prior written consent and any approval required by law or the building/society rules.
- Peaceful enjoyment: So long as the Tenant complies with this Agreement and applicable law, the Tenant shall be entitled to peaceful occupation of the Premises without unlawful interference.
- Inspection and access: Except in an emergency, the Landlord or authorised representative may enter the Premises for inspection, repairs or showing the property after giving reasonable prior notice and at a reasonable time, subject to applicable tenancy law.
- Compliance: Both parties shall comply with applicable municipal, apartment/society, safety, police-verification and tenancy requirements. The Tenant shall not conduct unlawful, hazardous or nuisance-causing activities in the Premises.
- Default: Non-payment of rent, material breach, unlawful use or other statutory ground may entitle the affected party to seek termination or other remedies, but eviction or recovery of possession must be pursued only in accordance with applicable law and due process.
- Notice and termination: Either party may terminate the tenancy by giving ____ days / ____ month(s) written notice, subject to any mandatory statutory requirement and any lawful ground or procedure applicable in the State/UT.
- Handover: On expiry or lawful termination, the Tenant shall return peaceful vacant possession of the Premises with keys and fixtures, subject to reasonable wear and tear.

- Applicable law and jurisdiction: This Agreement shall be governed by the laws applicable to the place where the Premises is situated, including any applicable State/UT tenancy or rent law. Disputes shall be dealt with by the competent Rent Authority, Rent Court, tribunal or court, as the applicable law provides.
- Entire understanding: This document, together with any signed inventory or annexure, records the agreed terms. Any amendment should be made in writing and signed by both parties, subject to applicable law.
