Section 53A IPC: Construction of Reference to Transportation
Section 53A of the Indian Penal Code, 1860 dealt with the legal construction of older statutory references to "transportation", including transportation for life and transportation for a term.
Text of Section 53A IPC
Section 53A(1): Subject to sub-sections (2) and (3), any reference to "transportation for life" in any other law for the time being in force, or in any instrument or order having effect by virtue of any such law or of any enactment repealed, shall be construed as a reference to "imprisonment for life".
Section 53A(2): In every case in which a sentence of transportation for a term was passed before the commencement of the Code of Criminal Procedure (Amendment) Act, 1955 (26 of 1955), the offender shall be dealt with in the same manner as if sentenced to rigorous imprisonment for the same term.
Section 53A(3): Any reference to transportation for a term or to transportation for any shorter term, by whatever name called, in any other law for the time being in force shall be deemed to have been omitted.
Section 53A(4): Any reference to "transportation" in any other law for the time being in force shall: (a) if the expression means transportation for life, be construed as a reference to imprisonment for life; and (b) if the expression means transportation for any shorter term, be deemed to have been omitted.
Meaning and purpose of Section 53A
Section 53A was an interpretative provision. Its purpose was to deal with references to the former punishment of transportation after the law moved away from that terminology. It established how such references in other laws, instruments and orders were to be read.

Transportation for life and imprisonment for life
For the construction addressed by Section 53A, a reference to "transportation for life" was to be read as a reference to "imprisonment for life", subject to the express qualifications in the section. The provision therefore served as a statutory bridge between older terminology and the punishment terminology used after the amendment.
Transportation for a fixed term
Section 53A treated transportation for a term differently from transportation for life. Sub-section (2) addressed sentences already passed before commencement of the Code of Criminal Procedure (Amendment) Act, 1955, while sub-section (3) dealt with references in other laws to transportation for a term or any shorter term.
Legislative history
Section 53A was inserted by Act 26 of 1955, section 117 and the Schedule, with effect from 1 January 1956. The reference in sub-section (2) was subsequently amended by Act 36 of 1957, section 3 and the Second Schedule, substituting "1955 (26 of 1955)" for the earlier reference to "1954".
Relationship with Section 53 IPC
Section 53 IPC set out the punishments to which offenders were liable under the IPC. Section 53A did not itself create a separate punishment or offence; it governed the construction of references to the former punishment of transportation.
Pre-BNS legal position
Section 53A formed part of the IPC immediately before the BNS came into force. The Bharatiya Nyaya Sanhita, 2023 repealed the IPC from 1 July 2024 subject to its repeal and savings provision. Section 53A therefore remains relevant when examining the historical IPC position and matters preserved by law following repeal.
