Section 444 IPC - Lurking House-Trespass by Night

Section 444 of the Indian Penal Code, 1860 defined when lurking house-trespass became lurking house-trespass by night. This article explains the provision in the legal framework applicable before the Bharatiya Nyaya Sanhita, 2023 came into force.

Pre-BNS legal position: This page explains Section 444 IPC in the law applicable before 1 July 2024. The Bharatiya Nyaya Sanhita, 2023 came into force on 1 July 2024 (subject to the notified exception concerning section 106(2)). For an offence or proceeding, the applicable law depends on the relevant date and the governing saving provisions.

Section 444 IPC: Statutory Definition

Whoever commits lurking house-trespass after sunset and before sunrise, is said to commit "lurking house-trespass by night".

Meaning of Lurking House-Trespass by Night

Section 444 builds upon the offence of lurking house-trespass under Section 443 IPC. The additional requirement under Section 444 is temporal: the lurking house-trespass must occur after sunset and before sunrise.

Accordingly, Section 444 should be read with the preceding provisions defining criminal trespass under Section 441, house-trespass under Section 442, and lurking house-trespass under Section 443.

Essential Ingredients of Section 444 IPC

Relationship with Sections 441, 442 and 443 IPC

ProvisionLegal concept
Section 441 IPCDefines criminal trespass, forming the basic concept from which house-trespass develops.
Section 442 IPCDefines house-trespass where criminal trespass concerns specified buildings, tents or vessels.
Section 443 IPCDefines lurking house-trespass where precautions are taken to conceal the house-trespass from a person entitled to exclude or eject the trespasser.
Section 444 IPCApplies where the lurking house-trespass occurs after sunset and before sunrise.

Section 444 and House-Breaking by Night

Lurking house-trespass by night should not be confused with house-breaking by night under Section 446 IPC. Section 444 concerns lurking house-trespass committed during the specified night-time period, whereas Sections 445 and 446 deal with house-breaking and house-breaking by night.

Punishment and Related Provisions

Section 444 is a definitional provision. Punishment depended on the applicable penal provision and circumstances. Relevant provisions included Section 453 IPC, along with aggravated forms addressed in Sections 449 to 452 IPC.

Legal Position Before Bharatiya Nyaya Sanhita 2023

For the legal framework covered by this article, Section 444 IPC supplied the definition of lurking house-trespass by night. The crucial distinction from ordinary lurking house-trespass was that the conduct occurred after sunset and before sunrise. The facts must therefore satisfy the underlying requirements of lurking house-trespass as well as the time requirement stated in Section 444.

Key Point

Section 444 IPC did not make every unauthorised entry at night a lurking house-trespass by night. The prosecution had to establish the underlying legal requirements of lurking house-trespass; the night-time requirement was an additional element.

This article is intended as a legal reference to the Indian Penal Code framework applicable before commencement of the Bharatiya Nyaya Sanhita, 2023. Statutory applicability should be checked against the date and facts of the particular matter.
