Section 60: Special Procedure for Voting by Certain Classes of Persons
Section 60 of the Representation of the People Act, 1951 enables specified classes of electors to vote through special arrangements, including postal ballots and, where permitted, proxy voting. The entitlement and method depend on the Act, the Conduct of Elections Rules, 1961, and applicable Election Commission notifications.
Purpose and relationship with Section 59
Section 59 establishes the general manner of voting by ballot and restricts proxy voting except as expressly provided by the Act. Section 60 operates without prejudice to that general rule and authorises special voting procedures to be prescribed by rules for defined groups. It does not confer unrestricted postal or proxy voting rights on every elector.
Section 60(a): Certain service voters
Clause (a) covers persons referred to in Section 20(8)(a) and (b) of the Representation of the People Act, 1950. Subject to the prescribed rules, such electors may be enabled to vote in person, by postal ballot or by proxy, and not by another method. Section 20(8) identifies categories of persons treated as ordinarily resident in a constituency by reason of their service or office; these include members of the armed forces of the Union and certain forces to which the Army Act, 1950 applies.
Section 60(b): Other specified service-related electors and spouses
Clause (b) enables the following persons to vote in person or by postal ballot, and not otherwise, subject to rules:
- Section 60(b)(i): persons referred to in Section 20(8)(c) or (d) of the 1950 Act, including members of an armed police force of a State serving outside that State and persons employed under the Government of India in posts outside India.
- Section 60(b)(ii): a qualifying wife of such a person to whom Section 20(3) of the 1950 Act applies and who is ordinarily residing with that person within the meaning of Section 20(6). The statutory wording must be read together with the relevant provisions of the 1950 Act.
The precise classification and procedure for service electors are governed by the relevant statutory provisions and election rules.
Section 60(c): Classes notified for postal ballot
Clause (c) permits persons belonging to classes notified by the Election Commission in consultation with the Government to vote by postal ballot, and not otherwise, subject to the requirements specified in the rules. This is an enabling provision: an elector must satisfy the applicable notified category, eligibility conditions, application requirements and deadlines.
The Conduct of Elections Rules, 1961, as amended, make provision for categories such as eligible senior citizens, persons with benchmark disabilities and electors performing specified essential services. Eligibility thresholds, documentation, application forms and the availability of home voting or other postal-ballot arrangements must be checked against the rules and Election Commission directions applicable to the particular election. For example, the age criterion for the notified senior-citizen postal-ballot category was revised from 80 years to 85 years in 2024; it should not be confused with a general right to postal voting for everyone over a given age.
Section 60(d): Preventive detention
Clause (d) enables a person subjected to preventive detention under a law in force to vote by postal ballot only, subject to the requirements prescribed by rules. Preventive detention is detention intended to prevent specified future conduct under an applicable law; it is distinct from ordinary detention following arrest or conviction. Voting rights in other custody situations require separate consideration under Section 62(5) and other applicable law.

- Confirm that the elector falls within a category recognised by Section 60, the applicable rules and any relevant Election Commission notification.
- Check the applicable registration, option or application procedure and its deadline; special voting arrangements are not automatically available to every person in a broad category.
- Follow the instructions issued by the returning officer and Election Commission concerning the permitted voting method and verification requirements.
