Section 24: General Duty of the Returning Officer under the RP Act, 1951

Section 24 of the Representation of the People Act, 1951 establishes the general responsibility of the Returning Officer to take the steps necessary to conduct an election effectively in accordance with the Act and the rules and orders made under it.

Section 24: Statutory text

It shall be the general duty of the returning officer at any election to do all such acts and things as may be necessary for effectually conducting the election in the manner provided by this Act and rules or orders made thereunder.

Meaning of Section 24

A Returning Officer (RO) is the election official designated or nominated by the Election Commission under Section 21. Section 24 imposes a broad duty to administer the election effectively, but only in the manner prescribed by law. It is not an independent power to disregard mandatory statutory procedures or Election Commission directions.

The expression "all such acts and things as may be necessary" recognises the range of practical arrangements needed for an election. The phrase "in the manner provided by this Act and rules or orders made thereunder" makes compliance with the applicable legal framework essential.

What does the Returning Officer do?

Depending on the type and stage of election, the RO's responsibilities under the RP Act, 1951 and the Conduct of Elections Rules, 1961 include:

  • Nomination process: receiving nomination papers, issuing required notices and conducting scrutiny in accordance with statutory requirements.
  • Withdrawal and candidates: processing valid withdrawals and preparing and publishing the list of contesting candidates.
  • Polling arrangements: coordinating election staff, polling-related materials and other arrangements within the statutory framework.
  • Counting and results: supervising the counting process, dealing with prescribed procedural requirements and declaring the result where legally permissible.
  • Records and compliance: maintaining and forwarding prescribed election records, reports and returns.

These are examples of functions governed by the Act, rules and applicable orders, rather than an exhaustive list created by Section 24 itself. Specific procedures, restrictions and powers are found in other provisions.

Returning Officer and Assistant Returning Officer

Section 22 allows the Election Commission to appoint Assistant Returning Officers (AROs). An ARO may perform authorised RO functions under the RO's control, but may scrutinise nominations only where the RO is unavoidably prevented from doing so. Under Section 23, references to an RO include an ARO performing functions validly authorised under Section 22(2), unless the context requires otherwise.
