A death occurring in Maharashtra must be registered with the Registrar having jurisdiction over the place where the death occurred. The competent authority can differ between rural and urban areas. Aaple Sarkar currently lists the Death Certificate service under the Rural Development and Panchayat Raj Department for notified rural services.
Current law governing death registration in Maharashtra
Death registration is governed principally by the Registration of Births and Deaths Act, 1969. The Act was amended by the Registration of Births and Deaths (Amendment) Act, 2023, with the amended provisions coming into force on 1 October 2023.
Who is responsible for reporting a death?
The responsible person depends on where the death occurred. The Maharashtra death-registration checklist currently identifies responsibility broadly as follows:
| Place of occurrence | Person responsible to report |
|---|---|
| Home / household | Head of the house or household, nearest relative present, or another person responsible under the applicable registration rules. |
| Private health institution | Medical Officer / person in charge of the institution. |
| Jail | Superintendent or officer in charge. |
| Hostel, dharmashala or shelter | Superintendent or person in charge. |
| Public place | Village headperson/corresponding officer or, in other areas, the officer in charge of the local police station, as applicable. |
| Government health institution | Follow the reporting procedure prescribed by the concerned institution and Registrar. |
The normal statutory reporting period is 21 days from the date of death. Once the event is registered, a certified death certificate can be issued by the competent registration authority.
Delayed registration of death after 21 days
Section 13 of the Registration of Births and Deaths Act, 1969, as amended with effect from 1 October 2023, governs delayed registration of births and deaths.
| Delay | Current legal position |
|---|---|
| After the normal reporting period but within 30 days | The death may be registered on payment of the prescribed late fee. |
| After 30 days but within 1 year | Written permission of the District Registrar or other prescribed authority is required, together with the prescribed fee and prescribed supporting documents. |
| After 1 year | Registration requires an order of the District Magistrate, Sub-Divisional Magistrate or Executive Magistrate authorised by the District Magistrate having jurisdiction over the place where the death occurred, after verification and payment of the prescribed fee. |
Apply for Maharashtra Death Certificate through Aaple Sarkar
Aaple Sarkar currently lists Death Certificate as an online service under the Rural Development and Panchayat Raj Department. This route is primarily relevant to notified rural/Gram Panchayat services. Urban local bodies and municipal corporations may use separate authorized systems.
- Visit the official Aaple Sarkar portal.
- Create a citizen account if you are not already registered.
- Log in using your registered credentials.
- Select the Rural Development and Panchayat Raj Department.
- Select Death Certificate.
- Enter the death-registration particulars and other information requested by the portal.
- Upload supporting documents if required and complete any applicable fee/payment step.
- Submit the application and save the acknowledgement/Application ID.
If the death occurred within a municipal corporation, municipal council or cantonment jurisdiction, use the official system or Registrar designated for that urban local body where required.
Track Death Certificate status and download
- Open Aaple Sarkar if the application was filed there.
- Select Track Your Application.
- Enter the Application ID or other details requested.
- Check whether the application is pending, approved, rejected or requires further action.
- When the certificate is digitally issued and the portal provides a download option, save the PDF for your records.
Where the death was registered through a municipal or corporation system, obtain the certificate through the applicable local-body portal or registration office rather than assuming that every death certificate will be available through Aaple Sarkar.
Maharashtra Right to Public Services time limit
The current Aaple Sarkar notified-services list shows the following for Death Certificate under the Rural Development Department:
| Item | Authority / Time |
|---|---|
| Notified service time | 5 working days |
| Designated Officer | Gram Sevak |
| First Appellate Authority | Assistant Block Development Officer |
| Second Appellate Authority | Block Development Officer |
For urban services, the notified time limit can differ. Aaple Sarkar's broader service listing currently shows certain Urban Development / BMC death-certificate services with a 3-day service period and different designated/appellate officers. Applicants should therefore use the authority applicable to the place of death.
The Maharashtra Right to Public Services Act, 2015, in force since 28 April 2015, provides a time-bound service framework and appeal rights where a notified service is delayed or wrongly rejected.
Correction of a death record
Correction or cancellation of an entry in the death register is a separate process from applying for a fresh certificate. If the registered particulars contain an error, apply to the competent Registrar under the procedure applicable to corrections rather than attempting to create a new death registration.
