Current Law: Registration of Births and Deaths Act

The Registration of Births and Deaths Act, 1969 remains the principal Central law governing registration of births and deaths. It was substantially amended by the Registration of Births and Deaths (Amendment) Act, 2023, with the amendments brought into force from 1 October 2023.

Delayed registration

Under the amended Section 13, a death reported after the prescribed period but within 30 days may be registered on payment of the prescribed late fee. Where information is given after 30 days but within one year, written permission of the District Registrar or other prescribed authority is required, together with the prescribed fee and supporting self-attested documents. If the death is reported after one year, an order of the District Magistrate, Sub-Divisional Magistrate, or an authorised Executive Magistrate having jurisdiction is required after verification.
