Section 76 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) explains how a warrant directed to one police officer may lawfully be executed by another police officer. 76. Warrant directed to police officer.
A warrant directed to any police officer may also be executed by any other police officer whose name is endorsed upon the warrant by the officer to whom it is directed or endorsed.
Meaning of Section 76 BNSS
Section 76 allows execution of an arrest warrant by a police officer other than the officer originally named in the warrant. This enables practical execution of the warrant without requiring the issuing court to issue a fresh warrant merely because another police officer has to carry out the arrest.
The authority of the other police officer is not automatic. The statute expressly requires that the officer's name be endorsed on the warrant by the officer to whom the warrant is directed or by an officer upon whom it has already been validly endorsed.
What Does "Endorsed Upon the Warrant" Mean?
In the context of Section 76, an endorsement is the formal recording on the warrant that authorizes another named police officer to execute it. The endorsement provides a documentary basis showing why the officer who actually executes the warrant is authorized to do so.
The wording of the section requires the other police officer to be identified by name on the warrant. A general or informal transfer of responsibility is therefore not the same as the endorsement contemplated by Section 76.
Who May Make the Endorsement?
Section 76 permits the endorsement to be made by:
- the police officer to whom the warrant is originally directed; or
- a police officer to whom the warrant has already been endorsed.
This structure permits the warrant to be passed for execution through authorized police channels while preserving a written link between the warrant and the officer who ultimately executes it.
Why Section 76 Is Important
Arrest warrants may have to be executed in changing operational circumstances. The officer originally named may be unavailable, transferred, engaged elsewhere or may require assistance from another officer.
