Section 32 BNSS - Aid to Person, Other Than Police Officer, Executing Warrant
Section 32 of the Bharatiya Nagarik Suraksha Sanhita, 2023 permits a person to assist in the execution of a warrant when the warrant is directed to a person other than a police officer, provided the person to whom the warrant is directed is near at hand and is acting in execution of that warrant.
Meaning and Scope of Section 32 BNSS
Section 32 deals with a specific situation in which a warrant has been directed to a person who is not a police officer. In that situation, another person may assist in executing the warrant, but only when the statutory conditions in Section 32 are satisfied.
The provision therefore supports execution of a warrant without treating the assisting person as an independent warrant-holder. The person named or otherwise lawfully directed by the warrant remains central to the execution.
Section 32 - Statutory Text
32. When a warrant is directed to a person other than a police officer, any other person may aid in the execution of such warrant, if the person to whom the warrant is directed be near at hand and acting in the execution of the warrant.
Conditions for Giving Aid Under Section 32
Section 32 contains three connected requirements:

What Does "Any Other Person May Aid" Mean?
Section 32 uses the expression "may aid". It authorises another person to assist in execution when the statutory conditions are met. This wording differs from Section 31, which states that every person is bound to assist a Magistrate or police officer when aid is reasonably demanded for the purposes listed there.
Section 32 should therefore be read as an enabling provision for assistance in the specified warrant-execution situation, rather than as the general public-duty rule contained in Section 31.
The Warrant-Holder Must Be Near at Hand
The assisting person's authority under Section 32 depends on the person to whom the warrant is directed being near at hand. The section does not authorise another person to take over execution independently while the warrant-holder is absent or remote from the execution.
Whether this requirement is satisfied depends on the actual circumstances of the execution.
The Warrant-Holder Must Be Acting in Execution of the Warrant
Physical proximity alone is not enough. Section 32 also requires the warrant-holder to be acting in the execution of the warrant. The assistance contemplated by the section is therefore ancillary to the warrant-holder's own execution of the warrant.
In an individual dispute, the warrant itself and the facts showing who was executing it, where the warrant-holder was located, and what assistance was actually given may be material.
