Section 45 IPC - Meaning of Life
Section 45 of the Indian Penal Code, 1860 defined the word "life" for purposes of the Code. Unless the context indicated otherwise, "life" denoted the life of a human being.
Section 45 of the Indian Penal Code 1860
The word "life" denotes the life of a human being, unless the contrary appears from the context.
Meaning of Life Under Section 45 IPC
The statutory definition is concise. When the IPC used the word "life," it ordinarily referred to the life of a human being. This definition supplied a consistent interpretive meaning across the Code, subject to the qualification expressly contained in Section 45.
Human Life Is the General Rule
The central element of Section 45 is the expression "life of a human being." The section therefore provides the ordinary statutory meaning of "life" wherever the term appears in the IPC and the surrounding context does not indicate a different meaning.
Section 45 is an interpretive provision. It does not itself create an offence, prohibit conduct or prescribe punishment. Its function is to define a word used elsewhere in the Code.
Importance of the Contextual Qualification
The words "unless the contrary appears from the context" prevent the definition from being applied mechanically where the wording, subject matter or structure of another IPC provision clearly requires a different reading.
Accordingly, Section 45 provides the general meaning, while the particular substantive provision supplies the context in which that meaning must be applied.
Section 45 and Section 46 IPC
Section 46 IPC similarly defined "death" as the death of a human being unless the contrary appeared from the context. Sections 45 and 46 therefore use parallel language for the concepts of life and death.
| IPC provision | Expression | General statutory meaning |
|---|---|---|
| Section 45 | Life | Life of a human being, unless the contrary appears from the context. |
| Section 46 | Death | Death of a human being, unless the contrary appears from the context. |
Relationship with Section 44 Injury
Section 44 IPC defined "injury" as any harm whatever illegally caused to any person in body, mind, reputation or property. Section 45 follows that definition and separately explains what "life" means when the expression is used in the Code.
Section 45 Is a Definition, Not an Offence
No criminal liability arises merely from Section 45. Where the word "life" appears in a substantive IPC provision, the ingredients and punishment are determined by that provision. Section 45 assists only in interpreting the expression.
