Section 215 IPC: Taking Gift to Help Recover Stolen Property

Section 215 of the Indian Penal Code, 1860 dealt with taking, agreeing, or consenting to take gratification under pretence or on account of helping another person recover movable property of which that person had been deprived by an offence punishable under the IPC.

Pre-BNS legal position: This article explains Section 215 IPC as applicable immediately before the Bharatiya Nyaya Sanhita, 2023 came into force on 1 July 2024. The penal law applicable to particular conduct depends on its date, facts and relevant saving provisions.

Section 215 IPC - meaning and scope

The section applied where a person took, agreed, or consented to take gratification under pretence or on account of helping a person recover movable property of which that person had been deprived by an offence punishable under the IPC. The provision imposed liability unless the person used all means in his power to cause the offender to be apprehended and convicted of the offence.

Essential ingredients of Section 215 IPC

  • The accused must take, agree, or consent to take gratification.
  • The gratification must be taken under pretence or on account of helping another person recover movable property.
  • The owner or other person must have been deprived of that movable property by an offence punishable under the IPC.
  • The statutory condition concerning use of all means in the person's power to cause the offender to be apprehended and convicted is central to the provision.

Meaning of movable property

Section 22 IPC defined "movable property" as including corporeal property of every description except land and things attached to the earth or permanently fastened to anything attached to the earth. Section 215 specifically concerned recovery of movable property.

Taking, agreeing or consenting to take gratification

The section was not limited to a completed receipt. It expressly covered a person who takes, agrees, or consents to take gratification. The gratification must be connected with the stated pretence or purpose of helping recover the movable property.

Property must have been lost through an IPC offence

The provision required that the person seeking recovery had been deprived of the movable property by an offence punishable under the Indian Penal Code. Section 215 therefore did not simply regulate every private arrangement for locating or returning property; the statutory connection with deprivation by an IPC offence was an express element.

Requirement to cause apprehension and conviction

Section 215 contained an important qualification: the person taking or agreeing to take the gratification was punishable unless he used all means in his power to cause the offender to be apprehended and convicted of the offence. This language distinguishes the prohibited conduct from genuine assistance directed toward recovery together with bringing the offender to legal punishment.

Punishment under Section 215 IPC

A person falling within Section 215 could be punished with imprisonment of either description for a term which may extend to two years, or fine, or both.

Section 215 compared with Sections 213 and 214 IPC

Section 213 IPC concerned taking or seeking gratification or restitution in consideration of concealing an offence, screening an offender, or not proceeding against an offender. Section 214 IPC dealt with the corresponding giving or offering side of such an arrangement. Section 215 specifically addressed gratification connected with helping recover movable property lost through an offence, subject to its requirement concerning apprehension and conviction of the offender.

Practical significance

The provision addressed arrangements in which a person sought a benefit for recovering property obtained through an offence without genuinely pursuing the offender's apprehension and conviction. Its focus was therefore not merely on payment for assistance, but on the statutory combination of gratification, recovery of offence-related movable property, and the person's conduct toward bringing the offender to justice.

Practical summary

Section 215 IPC punished taking, agreeing, or consenting to take gratification for helping recover movable property lost through an IPC offence unless the person used all means in his power to cause the offender's apprehension and conviction. The maximum punishment was two years' imprisonment, fine, or both.
