CrPC Forms 12, 13, 14 and 15: Bonds, Summons and Warrant for Security

Forms 12 to 15 formed part of the Second Schedule to the Code of Criminal Procedure, 1973 (CrPC). They dealt with preventive security proceedings: a bond to keep the peace, a bond for good behaviour, a summons based on information of a probable breach of the peace, and a warrant of commitment where security to keep the peace was not furnished.

Pre-BNSS law: This article presents the CrPC position applicable before the Bharatiya Nagarik Suraksha Sanhita, 2023 came into force on 1 July 2024. It is retained as a reference for proceedings and legal research requiring the earlier CrPC provisions. For current criminal procedure, refer to the BNSS, 2023.

The statutory forms below should be read with the relevant provisions of Chapter VIII of the CrPC and the Second Schedule. The original page incorrectly described Form 12 as an attachment order; under the Second Schedule, Form 12 is the Bond to Keep the Peace.

Relevant CrPC provisions explained

Section 106 - Security for keeping the peace on conviction: A Court of Session or Magistrate of the first class could, upon conviction for specified offences and where necessary for keeping the peace, require execution of a bond, with or without sureties, for a period not exceeding three years.
Section 107 - Security for keeping the peace in other cases: An Executive Magistrate who received information of a likely breach of the peace, disturbance of public tranquillity, or a wrongful act likely to cause such a breach could require the person concerned to show cause against an order to execute a bond, with or without sureties, for a period not exceeding one year.
Sections 108, 109 and 110 - Security for good behaviour: These provisions dealt respectively with specified dissemination or circulation of prohibited matter, suspected persons concealing their presence with a view to committing a cognizable offence, and habitual offenders. They empowered the competent Executive Magistrate, subject to the statutory conditions, to require security for good behaviour.
Section 113 - Summons or warrant where the person was not present: Where a person against whom an order had been made was not present in Court, the Magistrate could issue a summons requiring appearance, or a warrant where the person was in custody. In the circumstances specified in the proviso, an immediate warrant of arrest could also be issued to prevent an apprehended breach of the peace.
Section 122 - Imprisonment in default of security: This section governed commitment to prison where a person ordered to furnish security under the relevant provisions failed to furnish it, subject to the conditions and procedure laid down in the section.

WHEREAS I, __________ (name), inhabitant of __________ (place), have been called upon to enter into a bond to keep the peace for the term of __________ or until the completion of the inquiry in the matter of __________ now pending in the Court of __________, I hereby bind myself not to commit a breach of the peace, or do any act that may probably occasion a breach of the peace, during the said term or until the completion of the said inquiry and, in case of my making default therein, I hereby bind myself to forfeit to Government the sum of rupees __________.

WHEREAS I, __________ (name), inhabitant of __________ (place), have been called upon to enter into a bond to be of good behaviour to Government and all the citizens of India for the term of __________ (state the period) or until the completion of the inquiry in the matter of __________ now pending in the Court of __________, I hereby bind myself to be of good behaviour to Government and all the citizens of India during the said term or until the completion of the said inquiry; and, in case of my making default therein, I hereby bind myself to forfeit to Government the sum of rupees __________.

Where a bond with sureties is to be executed, add:

WHEREAS it has been made to appear to me by credible information that __________ (state the substance of the information), and that you are likely to commit a breach of the peace (or by which act a breach of the peace will probably be occasioned), you are hereby required to attend in person (or by a duly authorised agent) at the office of the Magistrate of __________ on the __________ day of __________, 20__________, at ten o'clock in the forenoon, to show cause why you should not be required to enter into a bond for rupees __________ [when sureties are required, add, and also to give security by the bond of one (or two, as the case may be) surety (or sureties) in the sum of rupees __________ (each if more than one)] that you will keep the peace for the term of __________.

WHEREAS __________ (name and address) appeared before me in person (or by his authorised agent) on the __________ day of __________ in obedience to a summons calling upon him to show cause why he should not enter into a bond for rupees __________ with one surety (or a bond with two sureties each in rupees __________) that he, the said __________ (name), would keep the peace for the period of __________ months; and whereas an order was then made requiring the said __________ (name) to enter into and find such security (state the security ordered when it differs from that mentioned in the summons), and he has failed to comply with the said order;

This is to authorise and require you to receive the said __________ (name) into your custody, together with this warrant, and him safely to keep in the said jail for the said period of __________ (term of imprisonment) unless he shall in the meantime be lawfully ordered to be released, and to return this warrant with an endorsement certifying the manner of its execution.
