Section 24 of the Central Vigilance Commission Act, 2003

Provisions relating to existing Vigilance Commission. Section 24 is a transitional provision that preserves legal and administrative continuity when the statutory Central Vigilance Commission constituted under Section 3 replaced the earlier Vigilance Commission established by Government Resolution.

In simple terms: Section 24 prevents disruption during the transition from the earlier non-statutory Vigilance Commission to the Commission constituted under the Central Vigilance Commission Act, 2003. Relevant earlier actions and decisions continue, pending proceedings move to the statutory Commission, employees continue on the same terms and conditions, and assets and liabilities transfer to the Commission.

Text and effect of Section 24

With effect from the constitution of the Commission under sub-section (1) of Section 3, the Central Vigilance Commission set up by Government of India Resolution No. 24/7/64-AVD dated 11 February 1964 continues, so far as its functions are not inconsistent with the Act, to discharge those functions. Section 24 then provides for the following consequences:

Actions and decisions of the existing Vigilance Commission, to the extent relatable to functions of the statutory Commission, are deemed to have been taken by the Commission constituted under the Act.
Pending proceedings relating to the Commission's functions are deemed transferred to the statutory Commission and are to be dealt with under the Act.
Employees of the existing Vigilance Commission are deemed to have become employees of the statutory Commission on the same terms and conditions.
All assets and liabilities of the existing Vigilance Commission stand transferred to the statutory Commission.

Relationship with Section 3
