How to Write a Professional Resignation Letter
- Be unambiguous: clearly state that you are resigning and identify the post or designation.
- Specify the date: mention the proposed last working day rather than using vague wording.
- Check the notice clause: verify the notice period, notice-pay provision and any valid handover requirements before requesting immediate release.
- Keep the reason brief: a detailed explanation is usually unnecessary unless required or useful for the circumstances.
- Record the handover: return employer property and retain reasonable proof of handover and submission of the resignation.
- Ask for acknowledgement: request written confirmation of receipt and the accepted last working date.
Notice Period and Immediate Resignation
A notice period may arise from the employment contract, applicable standing orders or service rules, an award or settlement, employer policy, or State-specific employment law. Employees should therefore verify the terms that govern their particular employment before choosing an effective date.
If the contract permits payment in lieu of notice, adjustment against accrued amounts or waiver by the employer, the resignation may request that option. A request for waiver does not by itself mean that the notice obligation has been waived; written confirmation from the employer is preferable.
Final Wages, Gratuity and Employment Documents
India's Code on Wages, 2019 is now part of the operative labour-law framework. Section 17 addresses the time for payment of wages and includes resignation among the events for which wages payable are to be settled within the statutory time prescribed, subject to any other legally applicable time limit.
Gratuity is governed by the Code on Social Security, 2020. In general, gratuity becomes payable on resignation after the qualifying continuous-service period where the statutory conditions are satisfied. Different rules apply to certain categories and situations, including fixed-term employment. Eligibility should be checked against the current Code, applicable rules and the facts of the employment.
