Previous publication of rules made by Central and State Government, Power to remove difficulties and Repeal and Saving - Section 112, 113 and 114 of Land Acquisition Act 2013

 

 

Previous publication of rules made by Central and State Government, Power to remove difficulties, Repeal and Saving  are defined under section 112, 113 and 114 of Land Acquisition Act 2013. Provisions under these Sections are :

 

Section 112 of Land Acquisition Act 2013 "Previous publication of rules made by Central and State Government"

The power to make rules by the Central or State Government under this Act shall be subject to the condition of the rules, being made after previous publication.

 

Section 113 of Land Acquisition Act 2013 "Power to remove difficulties"

(1) lf any difficulty arises in giving effect to the provisions of this Part, the Central Government may, by order, make such provisions or give such directions not inconsistent with the provisions of this Act as may appear to it to be necessary or expedient for the removal of the difficulty:

Provided that no such power shall be exercised after the expiry of a period of two years from the commencement of this Act.

(2) Every order made under this section shall be laid, as soon as may be after it is made, before each House of Parliament.

 

Section 114 of Land Acquisition Act 2013 "Repeal and Saving"

(1) The Land Acquisition Act, 1894 is hereby repealed.

(2) Save as otherwise provided in this Act the repeal under sub-section (1) shall not be held to prejudice or affect the general application of section 6 of the General Clauses Act, 1897 with regard to the effect of repeals.
